Abstract

The aim of this article is to present the legal framework of the human right of access to proper food by inciting the civil society to be protagonist in the implementation of public policies for such purpose. By using a descriptive methodology, the relationship between social pressures and advances in this issue is analyzed, bearing in mind the necessary social control over the Judiciary. Thus, it is expected that the human right to proper food anchored in international treaties, federal constitution and legislation are brought into practice by those working in the legal system. More effective measures stem from strengthening democracy, favoring social engagement and from the dialogue between civil society and the State through boards and conferences, which can be legitimated as means of mobilization, so that public policies shall be conceived, implemented and kept under surveillance. These political spaces relate to human right to proper food enforcement mechanisms, which should be safeguarded by the State and the legal system in order to provide guarantees enshrined in those rights, especially by preventing backward changes. Therefore, it is necessary to ensure that the population can reap the benefits of civil and political rights in a democratic state, which will possibilitate the occupation of public spaces and the social control in the context of legal support for the human rights to proper food, but that will depend on permanent surveillance by society.
