Abstract

The article, written as an essay, retrospectively analyzes the Brazilian urbanizing process, which is structured in three periods: the one before the Federal Constitution of 1988, the one between its publication and the City Statute’s, and the one that begins after that and continues until our days. The background presents a reduced action of the public power and consequently of the society’s role before a virtual absence of the State and Law. In terms of tendency, the article suggests a possible fragmentation of the legal system, difficulties to comprise urban areas as a complex set of interconnected rights and duties, conflicts in understanding the social function of the property, and legislative initiatives that disrespect regional diversities. From an optimistic perspective, the article concludes by consolidating Master Plans, as a first reference, and the urban policy as a suitable environment for the social movement development.
